REFUND & CANCELLATION POLICY
SPEAK IT WITH MS. DIAZ

LANGUAGE AND INTERPRETATION
This Refund & Cancellation Policy is provided in both English and Spanish for accessibility, convenience, and transparency. Both versions are intended to communicate the same substantive policies.
In the event of an unintended discrepancy, inconsistency, or difference in interpretation between the English and Spanish versions, the English-language version shall govern to the extent permitted by applicable law.
Nothing in this Policy is intended to waive, restrict, or eliminate any consumer right or remedy that cannot lawfully be waived.
1. PURPOSE AND SCOPE OF THIS POLICY
Speak It With Ms. Diaz provides live educational services that require advance lesson preparation, scheduling, technology, instructional planning, and, in the case of small-group programs, reservation of a limited Student space.
For these reasons, cancellation and refund eligibility depends on the type of service purchased, the date the cancellation request is received, whether the service has already begun, whether instructional time has already been reserved or provided, and the reason the service cannot be completed.
This Policy applies to privately purchased educational services offered by Speak It With Ms. Diaz, including fixed-term Spanish courses such as Explorer 1, Personalized Spanish Tutoring, Spanish Conversation Club, and other services unless different terms are expressly disclosed before purchase.
Charter school-funded services may be subject to additional or different school purchasing, cancellation, invoicing, attendance, or refund requirements as explained below.
2. RESPONSIBILITY TO REVIEW PROGRAM INFORMATION BEFORE PURCHASE
Before completing a purchase, the Parent/Guardian is responsible for reviewing the applicable program description, Student age requirements, Spanish-level requirements, schedule, start date, class frequency, class duration, technology requirements, price, and other enrollment information.
Parents are encouraged to contact Speak It With Ms. Diaz before purchasing if they are uncertain whether a program is appropriate for their child.
A Parent's failure to review publicly disclosed program information does not, by itself, create a right to a refund after the applicable cancellation period has expired.
If Speak It With Ms. Diaz materially misrepresents a purchased service or cannot provide the service substantially as described, this provision does not eliminate any remedy otherwise available under this Policy or applicable law.
3. FIXED-TERM GROUP COURSES
This section applies to Explorer 1 and other programs sold as a fixed-duration group course.
Because group enrollment is intentionally limited, each completed enrollment may reserve a place that could otherwise have been offered to another Student.
A Parent/Guardian may request a full refund when the cancellation request is received at least seven (7) calendar days before the published course start date.
For purposes of this Policy, the course start date means the date of the first scheduled instructional session, not the date on which the Student personally chooses to begin attending.
4. CANCELLATION LESS THAN SEVEN DAYS BEFORE A FIXED-TERM COURSE
If a cancellation request is received fewer than seven (7) calendar days before the published course start date, tuition is generally non-refundable.
This policy exists because, by that point, Speak It With Ms. Diaz may have reserved the Student's limited-capacity space, finalized group placement, prepared instructional resources, and reasonably relied on the enrollment when organizing the course.
A Parent's inability to attend because of a subsequent scheduling conflict, travel, change of plans, extracurricular activity, enrollment in another program, or other personal circumstance does not ordinarily create a right to a refund.
Nothing in this section prevents Speak It With Ms. Diaz from voluntarily granting an exception in extraordinary circumstances, nor does it limit a refund or remedy required by applicable law.
5. REFUNDS AFTER A FIXED-TERM COURSE HAS BEGUN
Once the first scheduled class of a fixed-term course has begun, tuition is generally non-refundable.
This applies even if the Student:
Does not attend the first class;
Begins attending at a later date;
Stops participating before the course ends;
Misses multiple classes;
Changes schools or homeschool arrangements;
Experiences a new scheduling conflict;
Decides the program is no longer preferred;
Enrolls in another Spanish program; or
Voluntarily withdraws.
The purchase reserves access to the program and instructional capacity for the applicable course period. Tuition is therefore not calculated solely according to the number of classes personally attended by the Student.
6. STUDENT ABSENCES FROM GROUP CLASSES
A Student's absence from a scheduled group class does not constitute cancellation by Speak It With Ms. Diaz.
Accordingly, missed group classes do not ordinarily qualify for:
Full or partial refunds;
Prorated tuition;
Account credits;
Private makeup classes;
Additional group sessions;
Extension of the Student's enrollment; or
Reduction of a future payment.
The Student may return to the next scheduled class without penalty.
When a recording of the missed session is available, the Student may use it to review the instructional content.
7. NOTICE OF STUDENT ABSENCE
Parents are requested to provide at least 24 hours' notice whenever they know their child will be absent from a course, tutoring session, or Conversation Club meeting.
For group programs, providing notice is appreciated and assists with instructional planning, but does not convert the missed class into a refundable or transferable session.
Failure to provide notice of a group-class absence does not prevent the Student from returning to the next regularly scheduled session.
Different rules apply to one-on-one tutoring because dedicated instructional time is reserved exclusively for one Student.
8. MISSED CLASSES AND RECORDING ACCESS
Speak It With Ms. Diaz may make educational recordings of classes available through a designated online platform.
When available, these recordings will ordinarily remain accessible for approximately 30 days.
A Student who misses a class may use the recording to review or complete the missed instructional content.
The availability of a recording is intended to provide educational continuity and does not convert a Student absence into a refund, credit, or entitlement to an additional live class.
Recordings are subject to the Terms & Conditions, Privacy Policy, and applicable Parent/Guardian consent.
9. ILLNESS OR EMERGENCY AFFECTING THE STUDENT
Speak It With Ms. Diaz understands that children may occasionally miss class because of illness, family emergency, unexpected travel disruption, power failure, or another circumstance outside the family's reasonable control.
The Student may ordinarily return to the next scheduled class without penalty.
For group programs, the missed class will nevertheless generally remain non-refundable because the class was provided and the Student's place remained reserved.
Where available, the Student may review the recording.
Speak It With Ms. Diaz may consider extraordinary circumstances individually, but doing so in one situation does not create an obligation to provide the same exception in another situation.
10. ONE-ON-ONE PERSONALIZED SPANISH TUTORING
Personalized Spanish Tutoring differs from group instruction because a specific instructional period is reserved exclusively for one Student.
A tutoring appointment may ordinarily be canceled or rescheduled without penalty when Speak It With Ms. Diaz receives at least 24 hours' notice before the scheduled start time.
The rescheduled appointment is subject to Instructor availability.
Providing sufficient notice does not guarantee that the replacement session can occur on the Parent's preferred date or time.
11. LATE TUTORING CANCELLATIONS
When a tutoring session is canceled fewer than 24 hours before its scheduled start time, the session may be considered used and the corresponding payment may be non-refundable.
This applies because the reserved instructional period may no longer reasonably be available to another Student.
Speak It With Ms. Diaz may make an exception for a documented or extraordinary emergency at its reasonable discretion.
An exception does not permanently modify this Policy or create an entitlement to future exceptions.
12. TUTORING NO-SHOWS
If a Student does not attend a scheduled tutoring appointment and the Parent/Guardian did not provide the required advance notice, the appointment may be considered a completed/used session for billing purposes.
The Instructor is not required to provide an additional replacement session or refund.
If the Student joins late, the Instructor may teach during the remaining scheduled time, but the session will ordinarily still end at its original scheduled time.
13. CONVERSATION CLUB
Spanish Conversation Club is a recurring small-group speaking-practice service rather than a pay-per-attended-class service.
The applicable monthly payment reserves participation during the applicable monthly service period and access to the scheduled sessions included in that period.
Student absences do not ordinarily reduce or prorate the monthly price.
Once a paid monthly service period has begun, the applicable monthly charge is generally non-refundable except where required by law or expressly provided by this Policy.
14. CONVERSATION CLUB AUTOMATIC RENEWAL
If Conversation Club is offered through an automatically renewing subscription, the Parent/Guardian will be shown the applicable recurring price, billing frequency, and applicable renewal information before completing the purchase.
By affirmatively enrolling in an automatically renewing plan, the Parent/Guardian authorizes the applicable recurring charges until the subscription is canceled in accordance with the disclosed cancellation method.
Any automatic-renewal arrangement remains subject to applicable law.
15. CANCELLING A RECURRING MEMBERSHIP
A Parent/Guardian may cancel an automatically renewing Conversation Club membership or other recurring service to prevent future renewals.
Cancellation generally becomes effective for future billing and does not retroactively cancel a service period that has already been purchased.
Unless otherwise required by law, a Parent who cancels during an already-paid service period will ordinarily retain access through the end of that paid period, and the account will not renew for the next period.
A cancellation should be submitted before the next scheduled renewal to prevent the next charge.
16. FAILURE TO ATTEND DOES NOT CANCEL A SUBSCRIPTION
Failure to attend classes does not constitute notice of cancellation.
A Parent/Guardian remains responsible for properly canceling an automatically renewing service through the cancellation method provided by Speak It With Ms. Diaz or the applicable payment platform.
Simply stopping attendance, failing to open class communications, or informing another Student or Parent does not cancel recurring billing.
17. LATE ARRIVAL
All live classes and tutoring sessions begin at the scheduled time.
A class will not ordinarily be delayed because a Student has not arrived.
A Student who arrives late may join the remaining portion when appropriate, but the class or tutoring session will ordinarily end at the originally scheduled time.
Time missed because of Student lateness is not refundable and will not ordinarily be added to the end of the session.
18. FEDERAL HOLIDAYS AND OTHER ANNOUNCED CLOSURES
If a regularly scheduled class falls on a federal holiday observed by Speak It With Ms. Diaz or another previously announced closure, the class may be moved to another weekday.
Such a schedule adjustment does not constitute cancellation of the purchased educational service and does not by itself create a right to a refund.
Replacement sessions will be scheduled Monday through Friday and will not ordinarily be scheduled on weekends.
For programs designed to meet twice per week, reasonable efforts will be made to maintain the intended frequency of two weekday instructional sessions.
The replacement date and time will be determined by the Instructor based on availability and program needs.
19. PARENT'S INABILITY TO ATTEND A RESCHEDULED GROUP CLASS
Because holiday or necessary makeup classes may require a different weekday or time, it is possible that a Student may be unable to attend the replacement session.
When the original class is legitimately rescheduled and the replacement instruction is made available, inability to attend the replacement class does not automatically create a right to a refund.
When available, the Student may access the recording of the replacement session for approximately 30 days.
Speak It With Ms. Diaz will make reasonable efforts to provide advance notice of scheduled changes whenever practicable.
20. CLASS CANCELED BY THE INSTRUCTOR
If the Instructor must cancel a class because of illness, emergency, unexpected technical failure, family emergency, power outage, or another circumstance outside her reasonable control, Speak It With Ms. Diaz will ordinarily provide a replacement class.
Reasonable efforts will be made to provide at least one hour's advance notice when circumstances permit.
If advance notice is impossible, families will be notified as soon as reasonably practicable.
A rescheduled replacement session ordinarily satisfies Speak It With Ms. Diaz's obligation to provide the affected instructional session.
21. INSTRUCTOR ILLNESS OR TEMPORARY INCAPACITY
If the Instructor is temporarily unable to teach because of illness or incapacity, affected classes may be rescheduled.
If the Instructor is unable to teach for more than one consecutive week, Speak It With Ms. Diaz will notify affected Parents by email as soon as reasonably practicable.
For fixed-term programs, the course completion date may be extended by approximately the amount of instructional time lost.
Such an extension does not ordinarily constitute cancellation of the course.
22. EXTENDED INABILITY TO PROVIDE SERVICES
If the Instructor becomes unable to provide a substantial remaining portion of a prepaid service and reasonable rescheduling or extension is not possible, Speak It With Ms. Diaz will determine an appropriate remedy based on the circumstances and services already provided.
Depending on the situation, this may include:
A prorated refund for the undelivered portion;
Account credit;
Transfer to another appropriate program;
Extension of services; or
Another mutually acceptable solution.
Speak It With Ms. Diaz will not retain payment for a substantial portion of a privately purchased service that it ultimately cannot provide where applicable law or this Policy requires a refund.
23. COURSE CANCELED BEFORE IT BEGINS
If Speak It With Ms. Diaz cancels an entire privately paid course before the first scheduled class and cannot provide a substantially equivalent alternative acceptable to the Parent/Guardian, the amount paid for that canceled course will be refunded.
The Parent is not required to accept a materially different course as a substitute for the canceled service.
24. INSUFFICIENT ENROLLMENT OR GROUP FORMATION
Certain small-group services depend on sufficient enrollment and appropriate Student placement.
If Speak It With Ms. Diaz cannot form or maintain an appropriate group, the Parent may be offered a different available group, adjusted start date, alternative schedule, another suitable service, credit, or refund, depending on the circumstances.
A Parent will not be required to accept a materially different service in place of a purchased service when a refund is otherwise appropriate.
25. CONVERSATION CLUB PLACEMENT
Conversation Club groups may be organized according to age and Spanish speaking level.
If payment is accepted before final placement and Speak It With Ms. Diaz subsequently determines that no appropriate group is available for the Student, the Parent may be offered another appropriate group or schedule.
If no reasonably appropriate placement can be provided and no alternative is accepted, payment for the unavailable service will be refunded when applicable.
26. PLATFORM OR INSTRUCTOR-SIDE TECHNICAL FAILURE
Speak It With Ms. Diaz relies on third-party technology to provide online instruction.
If a substantial failure of the teaching platform, Instructor's connection, or other Instructor-side technology prevents meaningful delivery of a scheduled class, Speak It With Ms. Diaz may reschedule the affected session.
When a reasonable replacement session is provided, the original technical interruption does not ordinarily create an additional right to a refund.
27. STUDENT-SIDE INTERNET OR TECHNOLOGY FAILURE
Parents are responsible for providing appropriate equipment, compatible technology, and an internet connection suitable for online instruction.
A Student's inability to participate because of household internet problems, device malfunction, discharged battery, microphone or camera failure, incompatible software, browser problems, forgotten login information, or similar Student-side circumstances generally constitutes a Student absence.
Such circumstances do not ordinarily qualify for a refund, credit, or additional live class.
When a group-class recording is available, the Student may use it to review the missed instruction.
28. FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL
Events outside the reasonable control of Speak It With Ms. Diaz may occasionally prevent or delay instruction.
Examples may include natural disasters, severe weather, widespread power or internet outages, government orders, emergencies, major third-party platform failures, or other comparable events.
Where reasonably possible, Speak It With Ms. Diaz will first attempt to reschedule, extend, or otherwise provide the purchased instruction.
If a substantial remaining portion of a prepaid service ultimately cannot be provided, any refund, credit, or alternative remedy will be determined in accordance with this Policy and applicable law.
29. CHANGES REQUESTED BY THE PARENT
Requests to transfer a Student to a different time, group, program, or service are subject to availability and are not guaranteed.
Approval of a transfer does not automatically change the amount paid or create a refund entitlement.
If the requested replacement service has a different price, Speak It With Ms. Diaz will communicate any applicable payment adjustment before completing the transfer.
30. PROGRAM DISSATISFACTION OR CHANGE OF PREFERENCE
Speak It With Ms. Diaz encourages Parents to review program descriptions and contact the Instructor before enrolling if they have questions regarding program fit.
After the applicable refund period has expired, dissatisfaction based solely on personal preference, teaching-style preference, a child's reluctance to participate, or a decision to use a different educational provider does not ordinarily create a right to a refund.
This provision does not apply where the purchased service was materially misrepresented or where a refund is otherwise required by applicable law.
31. STUDENT BEHAVIOR AND TERMINATION OF PARTICIPATION
Speak It With Ms. Diaz may take reasonable action when a Student's conduct substantially interferes with instruction, compromises privacy or safety, or repeatedly prevents the class from functioning appropriately.
Where practicable, the Parent will be informed of recurring concerns before enrollment is terminated.
Serious misconduct or safety concerns may require immediate action.
If participation is terminated because of serious or repeated violations of the Terms & Conditions, a refund is not automatically guaranteed.
Any refund determination will consider the reason for termination, services already delivered, remaining prepaid services, circumstances of the case, and applicable law.
32. PARENT/GUARDIAN CONDUCT
Harassment, threats, fraudulent conduct, abusive communications, serious privacy violations, unauthorized distribution of class recordings, or other substantial violations of the Terms & Conditions may result in termination of services.
Termination for such conduct does not automatically create a right to a full refund.
Any amount legally required to be returned will nevertheless be refunded.
33. PAYMENT PLANS FOR FIXED-TERM COURSES
If a fixed-term course is offered through an installment or payment plan, the installment arrangement is a method of paying for the applicable course and does not necessarily convert the course into a month-to-month service.
Unless expressly stated otherwise at checkout, withdrawing from a fixed-term course after the applicable refund period does not automatically cancel amounts validly owed under an agreed payment plan.
The specific payment schedule and cancellation terms disclosed at enrollment will apply, subject to applicable law.
34. FAILED OR DECLINED PAYMENTS
If a scheduled payment is declined or cannot be processed, Speak It With Ms. Diaz may contact the Parent to request an updated payment method.
Access to future services may be suspended when required payments remain outstanding.
A declined payment does not itself constitute cancellation by the Parent.
The Parent remains responsible for following the applicable cancellation procedure.
35. DUPLICATE OR INCORRECT CHARGES
Parents should contact Speak It With Ms. Diaz promptly if they believe they have been:
Charged twice for the same transaction;
Charged an incorrect amount;
Charged after a properly processed cancellation;
Charged for a service they did not purchase; or
Affected by another billing error.
Confirmed billing errors will be corrected.
This section does not prevent a Parent from exercising rights available through their financial institution or applicable law.
36. CHARTER SCHOOL-FUNDED SERVICES
Charter school-funded services may operate under purchase orders, service agreements, invoicing requirements, attendance verification, approved-vendor rules, or other requirements established by the applicable charter school.
When a charter school is the payer, refunds or billing adjustments may need to be returned or credited directly to the charter school rather than to the Parent.
Parents are responsible for understanding their charter school's purchasing requirements.
Speak It With Ms. Diaz will comply with applicable contractual obligations governing the transaction.
37. PRIVATE PURCHASES AND EXPECTED CHARTER REIMBURSEMENT
A Parent should not privately purchase a service based solely on an assumption that a charter school will later reimburse the purchase unless the school has confirmed that arrangement.
Speak It With Ms. Diaz does not control individual charter-school reimbursement decisions.
A charter school's later refusal to reimburse a Parent for a private purchase does not, by itself, create a right to a refund from Speak It With Ms. Diaz after the applicable private-purchase refund deadline has expired.
38. DISCOUNTS, PROMOTIONAL PRICING, AND COUPONS
When an approved refund applies to a purchase made with a discount, coupon, promotional price, scholarship, or other price reduction, the refund will be calculated based on the amount actually paid by or on behalf of the customer, not the undiscounted retail value.
Discounts have no independent cash value unless expressly stated otherwise.
39. REFUND METHOD
Approved refunds will ordinarily be returned to the original payment method used for the transaction.
Speak It With Ms. Diaz may require reasonable verification before processing a refund to protect against fraud or payment errors.
The time required for a refund to appear in the Parent's account may depend on the payment processor, card issuer, bank, or financial institution and is outside the direct control of Speak It With Ms. Diaz after the refund has been submitted.
40. PAYMENT PROCESSING FEES
Payments may be processed through third-party payment providers.
Any treatment of payment-processing fees in connection with refunds will comply with applicable law, the terms of the applicable processor, and the terms disclosed in connection with the transaction.
Nothing in this provision permits Speak It With Ms. Diaz to withhold an amount that applicable law requires to be refunded.
41. HOW TO REQUEST A CANCELLATION OR REFUND
Cancellation and refund requests should be submitted through an official Speak It With Ms. Diaz communication channel.
The request should include, when applicable:
Parent/Guardian full name;
Student name;
Program or service purchased;
Email address used for the purchase;
Order or transaction information, if available;
Date of the scheduled service or course;
Whether the Parent is requesting cancellation, rescheduling, credit, or refund; and
A brief explanation sufficient to identify the request.
The date and time the request is received through an official communication channel will ordinarily be used to determine whether an applicable cancellation deadline was satisfied.
42. REFUND REVIEW
Submitting a refund request does not automatically mean that a refund has been approved.
Speak It With Ms. Diaz may review the transaction, attendance history, applicable cancellation deadline, services already provided, communications, payment records, and relevant circumstances before determining whether the request qualifies under this Policy.
Approved refunds will be processed within a reasonable period.
43. PAYMENT DISPUTES AND CHARGEBACKS
Parents are encouraged to contact Speak It With Ms. Diaz promptly when they believe a billing error has occurred so that the matter can be reviewed.
Nothing in this Policy eliminates a Parent's lawful right to dispute a transaction with their financial institution.
However, knowingly submitting false information in connection with a payment dispute, falsely claiming that an authorized purchase was unauthorized, or otherwise engaging in payment fraud may result in termination of services.
Speak It With Ms. Diaz may provide relevant transaction records, enrollment information, acceptance records, attendance records, communications, and applicable policies to a payment processor or financial institution when reasonably necessary to respond to a lawful payment dispute.
44. PROMOTIONAL MEDIA AUTHORIZATION IS COMPLETELY SEPARATE FROM REFUND ELIGIBILITY
Promotional media authorization is voluntary and is not consideration for, or a condition of, receiving educational services.
A Parent/Guardian may choose:
Full Media Authorization — Image and Voice;
Voice-Only Authorization — allowing authorized promotional use of the Student's voice while requiring the Student's face to remain completely obscured or otherwise visually de-identified; or
No Promotional Authorization — declining promotional use of both identifiable image and identifiable voice.
The selected authorization level will not increase or reduce tuition, affect enrollment eligibility, affect the quality of instruction provided to the Student, or alter the Parent's rights under this Refund & Cancellation Policy.
A Parent will never be denied an otherwise valid refund solely because they declined promotional authorization, selected Voice-Only Authorization, or later changed or withdrew optional promotional consent.
45. EDUCATIONAL RECORDING CONSENT AND REFUNDS
Educational recording consent is separate from optional promotional media authorization.
Certain programs may rely on class recordings as part of their disclosed educational delivery model.
Parents should review the applicable recording information and Parent/Guardian Consent before enrollment.
If a Parent does not consent to a recording practice that is necessary for the selected program, the Parent should contact Speak It With Ms. Diaz before purchasing to determine whether an appropriate alternative is available.
Speak It With Ms. Diaz does not guarantee that a non-recorded version of every group program can be offered.
This provision does not eliminate refund rights that otherwise apply under this Policy or applicable law.
46. EXCEPTIONS REQUIRED BY LAW
Nothing in this Policy is intended to exclude, restrict, or waive any refund, cancellation, consumer-protection, privacy, or other right that cannot lawfully be waived.
Where applicable federal, California, or other controlling law requires a different result, applicable law will control.
47. DISCRETIONARY EXCEPTIONS
Speak It With Ms. Diaz may, at its discretion, provide a refund, credit, transfer, rescheduling accommodation, or other exception beyond what this Policy requires when extraordinary circumstances justify doing so.
Providing an exception in one instance does not amend this Policy, create a continuing obligation, or require the same exception for another family or future situation.
Decisions will not be made on an unlawfully discriminatory basis.
48. CHANGES TO THIS POLICY
Speak It With Ms. Diaz may update this Policy to reflect changes in programs, payment methods, technology, business practices, or applicable legal requirements.
The current version will be published on the website with its effective or revision date.
For an existing purchase, the version in effect at the time of purchase will ordinarily govern that transaction unless a later change is legally required or is expressly made applicable in a manner permitted by law.
49. RELATIONSHIP TO TERMS & CONDITIONS
This Refund & Cancellation Policy forms part of the Terms & Conditions applicable to purchases from Speak It With Ms. Diaz.
If another enrollment page contains a service-specific cancellation or refund term, that term should be read together with this Policy.
Where an unavoidable conflict exists, the more specific term disclosed to the Parent before the applicable purchase will ordinarily control for that particular service, subject to applicable law.

1. PROPÓSITO Y ALCANCE
Speak It With Ms. Diaz proporciona servicios educativos en vivo que requieren preparación anticipada, programación, tecnología, planeación de clases y, en programas grupales, la reserva de un espacio limitado para cada Estudiante.
Por esta razón, la elegibilidad para cancelaciones y reembolsos dependerá del servicio adquirido, la fecha de la solicitud, si el servicio ya comenzó, si el tiempo de enseñanza ya fue reservado o proporcionado y las circunstancias que impidan completar el servicio.
Esta Política aplica a cursos de duración determinada como Explorer 1, Personalized Spanish Tutoring, Spanish Conversation Club y otros servicios privados, salvo que se indiquen condiciones diferentes antes de la compra.
Los servicios financiados por charter schools podrán estar sujetos a reglas adicionales de la institución correspondiente.
2. RESPONSABILIDAD DE REVISAR EL PROGRAMA
Antes de realizar una compra, el Padre/Tutor es responsable de revisar la descripción del programa, edades, nivel requerido de español, horario, fecha de inicio, frecuencia, duración, requisitos tecnológicos, precio y demás información de inscripción.
Cuando existan dudas sobre si el programa resulta adecuado para el menor, se recomienda contactar a Speak It With Ms. Diaz antes de comprar.
No revisar información claramente proporcionada antes de la compra no genera, por sí solo, derecho a reembolso después de vencido el periodo de cancelación.
3. CURSOS GRUPALES DE DURACIÓN FIJA
Esta sección aplica a Explorer 1 y otros cursos grupales de duración determinada.
Debido a que los grupos tienen capacidad limitada, cada inscripción reserva un espacio que podría haber sido utilizado por otro Estudiante.
Podrá solicitarse un reembolso completo cuando la solicitud se reciba al menos siete (7) días naturales antes de la fecha publicada de inicio del curso.
La fecha de inicio es la primera sesión programada del curso, independientemente de que el Estudiante decida asistir o no.
4. CANCELACIÓN CON MENOS DE SIETE DÍAS
Cuando la solicitud se reciba menos de siete días naturales antes del inicio, la matrícula será generalmente no reembolsable.
Para ese momento, Speak It With Ms. Diaz puede haber reservado el espacio del Estudiante, finalizado grupos y horarios y preparado materiales.
Cambios personales de horario, viajes, actividades extracurriculares, cambios de planes o elección de otro programa normalmente no generan derecho a reembolso.
Podrán considerarse excepciones extraordinarias a discreción razonable de Speak It With Ms. Diaz, sin eliminar derechos exigidos por ley.
5. DESPUÉS DEL INICIO DEL CURSO
Una vez iniciada la primera clase programada, la matrícula será generalmente no reembolsable.
Esto aplica aunque el Estudiante no asista a la primera clase, empiece posteriormente, deje de asistir antes de terminar, tenga conflictos de horario, cambie de escuela o programa, elija otro proveedor o se retire voluntariamente.
La matrícula reserva el acceso y espacio del Estudiante durante el programa y no se calcula exclusivamente según las clases a las que personalmente asista.
6. AUSENCIAS EN CLASES GRUPALES
Una ausencia del Estudiante no constituye una cancelación por parte de Speak It With Ms. Diaz.
Las clases grupales perdidas normalmente no generan derecho a reembolso total o parcial, reducción proporcional, crédito, clase privada de recuperación, sesión adicional o extensión del curso.
El Estudiante podrá regresar a la siguiente clase programada.
7. AVISO DE AUSENCIA
Se solicita avisar con al menos 24 horas de anticipación cuando se conozca que el Estudiante faltará.
En programas grupales, este aviso ayuda a la planeación, pero no convierte la sesión perdida en una clase reembolsable o transferible.
8. GRABACIONES DE CLASES PERDIDAS
Cuando exista grabación educativa, ésta podrá estar disponible aproximadamente durante 30 días mediante la plataforma indicada.
La grabación permite mantener continuidad educativa, pero no convierte la ausencia en derecho a reembolso, crédito o clase adicional.
9. ENFERMEDAD O EMERGENCIA DEL ESTUDIANTE
Si el Estudiante falta por enfermedad, emergencia familiar, problemas inesperados de viaje, fallas eléctricas u otra situación fuera del control razonable de la familia, podrá regresar a la siguiente clase.
En programas grupales, la sesión seguirá siendo normalmente no reembolsable porque la clase fue proporcionada y el espacio permaneció reservado.
Podrán considerarse circunstancias extraordinarias individualmente.
10. TUTORÍAS INDIVIDUALES
Una sesión de Personalized Spanish Tutoring reserva tiempo exclusivamente para un Estudiante.
Podrá cancelarse o reprogramarse normalmente sin penalización cuando Speak It With Ms. Diaz reciba al menos 24 horas de aviso.
La nueva fecha estará sujeta a disponibilidad de la Maestra y no se garantiza el horario preferido por la familia.
11. CANCELACIONES TARDÍAS DE TUTORING
Una sesión cancelada con menos de 24 horas de anticipación podrá considerarse utilizada y su pago podrá ser no reembolsable.
Podrán considerarse excepciones extraordinarias a discreción razonable.
Una excepción no modifica permanentemente esta Política.
12. NO-SHOW DE TUTORING
Si el Estudiante no se presenta y no existió aviso suficiente, la sesión podrá considerarse utilizada.
Si llega tarde, podrá participar durante el tiempo restante, pero la sesión terminará normalmente a la hora originalmente programada.
13. CONVERSATION CLUB
Spanish Conversation Club es un servicio grupal recurrente de práctica oral y no un servicio cobrado exclusivamente por cada clase a la que el Estudiante asiste.
El pago mensual reserva la participación durante el periodo correspondiente.
Las ausencias no reducen proporcionalmente la mensualidad.
Una vez iniciado el periodo mensual pagado, la mensualidad será generalmente no reembolsable salvo que la ley o esta Política establezcan otra cosa.
14. RENOVACIÓN AUTOMÁTICA
Cuando Conversation Club u otro servicio tenga renovación automática, se informará antes de la compra el precio recurrente, frecuencia y condiciones aplicables.
El Padre/Tutor deberá aceptar afirmativamente la renovación automática.
15. CANCELACIÓN DE MEMBRESÍAS
La cancelación podrá realizarse antes de la siguiente renovación para impedir futuros cargos.
Normalmente, cancelar una membresía detiene futuras renovaciones, pero no cancela retroactivamente un periodo que ya fue adquirido.
Salvo que la ley exija otra cosa, el Estudiante podrá continuar utilizando el periodo ya pagado hasta su terminación.
16. DEJAR DE ASISTIR NO CANCELA LA SUSCRIPCIÓN
Dejar de asistir no constituye cancelación.
El Padre/Tutor es responsable de realizar correctamente la cancelación mediante el procedimiento proporcionado.
No asistir, ignorar comunicaciones o simplemente dejar de utilizar el servicio no detiene automáticamente una renovación.
17. LLEGADAS TARDE
Las clases comienzan puntualmente.
Una llegada tarde no extenderá normalmente la sesión ni generará reembolso por el tiempo perdido.
18. DÍAS FESTIVOS
Cuando una clase coincida con un día festivo federal observado por Speak It With Ms. Diaz u otro cierre previamente anunciado, podrá trasladarse a otro día.
Esto no constituye cancelación del servicio.
Las recuperaciones serán de lunes a viernes y normalmente nunca en fines de semana.
Para cursos de dos sesiones semanales, se realizarán esfuerzos razonables para mantener dicha frecuencia.
La Maestra determinará el nuevo horario según disponibilidad y necesidades del programa.
19. IMPOSIBILIDAD DE ASISTIR A UNA CLASE REPROGRAMADA
Cuando una clase haya sido legítimamente reprogramada, la imposibilidad del Estudiante de asistir al nuevo horario no genera automáticamente derecho a reembolso.
Cuando exista grabación, podrá utilizarse para revisar el contenido.
20. CANCELACIONES DE LA MAESTRA
Cuando la Maestra deba cancelar por enfermedad, emergencia, falla tecnológica u otra circunstancia fuera de su control razonable, normalmente se proporcionará una sesión de reemplazo.
Se procurará avisar con al menos una hora de anticipación cuando resulte posible.
21. INCAPACIDAD TEMPORAL
Cuando la Maestra no pueda impartir clases durante más de una semana consecutiva, las familias afectadas serán notificadas por email tan pronto como razonablemente sea posible.
El curso podrá extenderse aproximadamente por el tiempo perdido.
22. IMPOSIBILIDAD PROLONGADA DE PRESTAR EL SERVICIO
Si una parte sustancial de un servicio prepagado no puede proporcionarse ni reprogramarse razonablemente, podrá ofrecerse, según las circunstancias, un reembolso proporcional, crédito, transferencia, extensión u otra solución apropiada.
Speak It With Ms. Diaz no retendrá el pago correspondiente a una parte sustancial de un servicio privado que finalmente no pueda proporcionar cuando esta Política o la legislación aplicable requieran un reembolso.
23. CANCELACIÓN COMPLETA ANTES DEL INICIO
Si Speak It With Ms. Diaz cancela completamente un curso privado antes de comenzar y no proporciona una alternativa sustancialmente equivalente aceptada por el Padre/Tutor, se reembolsará la cantidad pagada por dicho curso.
24. FALTA DE INSCRIPCIONES O FORMACIÓN DE GRUPO
Algunos programas requieren suficiente inscripción y compatibilidad entre Estudiantes.
Cuando no pueda formarse un grupo apropiado, podrá ofrecerse otro grupo, fecha de inicio, horario, servicio, crédito o reembolso según corresponda.
25. PLACEMENT DE CONVERSATION CLUB
Los grupos pueden formarse según edad y nivel oral.
Si después del pago no existe un grupo razonablemente apropiado, podrá ofrecerse otra opción.
Si ninguna opción apropiada puede proporcionarse y la familia no acepta una alternativa, el pago correspondiente podrá ser reembolsado.
26. FALLAS DE PLATAFORMA O DEL LADO DE LA MAESTRA
Cuando una falla sustancial de la plataforma, conexión o tecnología del lado de la Maestra impida impartir significativamente una clase, ésta podrá reprogramarse.
La realización razonable de la sesión de reemplazo normalmente satisface la obligación de proporcionar dicha clase.
27. FALLAS DE INTERNET O TECNOLOGÍA DEL ESTUDIANTE
Los Padres son responsables de proporcionar tecnología y conexión adecuadas.
Fallas del internet del hogar, dispositivo, batería, cámara, micrófono, navegador, software o información de acceso normalmente serán consideradas una ausencia del Estudiante y no generarán reembolso, crédito o clase adicional.
28. FUERZA MAYOR
Desastres naturales, clima severo, apagones generalizados, órdenes gubernamentales, emergencias, fallas importantes de plataformas y otros eventos fuera del control razonable podrán provocar retrasos o reprogramaciones.
Speak It With Ms. Diaz procurará primero proporcionar, extender o reprogramar el servicio.
Si finalmente no puede proporcionarse una parte sustancial del servicio prepagado, se aplicarán los remedios correspondientes conforme a esta Política y la ley.
29. CAMBIOS SOLICITADOS POR LOS PADRES
Los cambios de horario, grupo, programa o servicio solicitados por la familia estarán sujetos a disponibilidad y no están garantizados.
Cuando el servicio alternativo tenga un precio diferente, cualquier ajuste será comunicado antes de realizar el cambio.
30. INSATISFACCIÓN O CAMBIO DE PREFERENCIA
Después de vencido el periodo aplicable de reembolso, un cambio de preferencia, desacuerdo con el estilo educativo, falta de interés del menor o elección de otro proveedor no genera normalmente derecho a reembolso.
Esto no aplica cuando exista una tergiversación sustancial del servicio o la legislación establezca otro derecho.
31. CONDUCTA DEL ESTUDIANTE
La participación podrá terminarse cuando exista conducta grave o reiterada que interfiera sustancialmente con la clase, privacidad o seguridad.
La terminación por incumplimiento no garantiza automáticamente un reembolso.
Cualquier decisión considerará servicios proporcionados, servicios restantes, circunstancias y legislación aplicable.
32. CONDUCTA DEL PADRE/TUTOR
Acoso, amenazas, fraude, comunicaciones abusivas, violaciones graves de privacidad o distribución no autorizada de grabaciones podrán ocasionar terminación de servicios.
Esto no elimina cantidades que legalmente deban ser reembolsadas.
33. PLANES DE PAGOS
Cuando un curso de duración fija pueda pagarse mediante mensualidades o installments, dicho plan constituye normalmente una forma de pagar el curso completo y no necesariamente una suscripción mensual.
Salvo que el checkout establezca otra cosa, retirarse del curso después del periodo aplicable de reembolso no cancela automáticamente cantidades válidamente adeudadas bajo un plan de pagos aceptado.
34. PAGOS RECHAZADOS
Cuando un pago sea rechazado, podrá solicitarse un método de pago actualizado.
El acceso a futuros servicios podrá suspenderse cuando existan pagos requeridos pendientes.
Un pago rechazado no constituye automáticamente cancelación.
35. CARGOS DUPLICADOS O INCORRECTOS
Los Padres deberán informar rápidamente cualquier cargo duplicado, cantidad incorrecta, cargo posterior a una cancelación válida, compra no realizada u otro error.
Los errores confirmados serán corregidos.
36. CHARTER SCHOOL FUNDS
Los servicios financiados mediante charter schools podrán estar sujetos a órdenes de compra, facturación, verificación de asistencia y reglas específicas.
Cuando la charter school sea quien realiza el pago, cualquier devolución correspondiente podrá tener que efectuarse directamente a la institución y no al Padre/Tutor.
37. COMPRA PRIVADA ESPERANDO REEMBOLSO DE CHARTER
Speak It With Ms. Diaz no controla las decisiones de reembolso de una charter school.
Si un Padre compra privadamente esperando posteriormente recibir fondos de su escuela y ésta rechaza el reembolso, dicha decisión no genera por sí sola un derecho de devolución después de vencido el periodo aplicable.
38. DESCUENTOS Y CUPONES
Los reembolsos aprobados sobre compras con descuento se calcularán sobre la cantidad efectivamente pagada y no sobre el precio regular.
39. MÉTODO DE REEMBOLSO
Los reembolsos aprobados se devolverán normalmente al método de pago original.
El tiempo necesario para reflejarse dependerá del banco, emisor o procesador correspondiente una vez enviado el reembolso.
40. COMISIONES DE PROCESAMIENTO
El tratamiento de comisiones relacionadas con pagos y reembolsos cumplirá las leyes y reglas del procesador aplicables.
Nada de esta sección permite retener cantidades cuya devolución sea obligatoria por ley.
41. CÓMO SOLICITAR UNA CANCELACIÓN O REEMBOLSO
La solicitud deberá enviarse mediante un canal oficial de Speak It With Ms. Diaz e incluir, cuando corresponda, nombre del Padre/Tutor, nombre del Estudiante, programa, email de compra, información de la orden, fecha del servicio y la acción solicitada.
La fecha y hora en que se reciba la solicitud determinará normalmente el cumplimiento de los plazos aplicables.
42. REVISIÓN DE LA SOLICITUD
Enviar una solicitud no significa que el reembolso haya sido automáticamente aprobado.
Podrán revisarse la transacción, asistencia, plazos, servicios ya proporcionados, comunicaciones, registros de pago y circunstancias relevantes.
43. DISPUTAS DE PAGO Y CHARGEBACKS
Se recomienda contactar a Speak It With Ms. Diaz rápidamente ante cualquier problema de facturación.
Nada limita el derecho legal del consumidor a disputar una transacción.
Sin embargo, proporcionar intencionalmente información falsa en una disputa o declarar fraudulentamente como no autorizada una compra legítimamente autorizada podrá ocasionar terminación de servicios.
Speak It With Ms. Diaz podrá proporcionar al procesador o institución financiera registros pertinentes de la transacción, inscripción, aceptación de políticas, asistencia y comunicaciones cuando resulte razonablemente necesario para responder a una disputa legítima.
44. LA AUTORIZACIÓN PROMOCIONAL ES INDEPENDIENTE DE LOS REEMBOLSOS
La autorización promocional es voluntaria y no constituye condición para recibir servicios educativos.
El Padre/Tutor podrá seleccionar:
Autorización Completa — Imagen y Voz;
Autorización Únicamente de Voz — permitiendo la voz pero manteniendo el rostro completamente oculto o visualmente desidentificado; o
Sin Autorización Promocional — rechazando imagen identificable y voz identificable.
La opción seleccionada no modificará el precio, elegibilidad, calidad educativa ni derechos de reembolso.
Ningún reembolso que resulte válido será rechazado únicamente porque el Padre/Tutor haya rechazado publicidad, seleccionado únicamente voz o posteriormente modificado o retirado su consentimiento promocional.
45. GRABACIÓN EDUCATIVA Y REEMBOLSOS
La autorización para grabación educativa es independiente de la autorización promocional.
Algunos programas pueden utilizar grabaciones como parte de su formato educativo informado.
Cuando un Padre no acepte una práctica de grabación necesaria para el formato del programa, deberá contactar a Speak It With Ms. Diaz antes de comprar para determinar si existe una alternativa.
No se garantiza que todos los programas grupales puedan proporcionarse sin grabación.
Esta disposición no elimina derechos de reembolso que correspondan conforme a esta Política o la legislación.
46. EXCEPCIONES EXIGIDAS POR LEY
Nada en esta Política elimina derechos de reembolso, cancelación o protección del consumidor que legalmente no puedan renunciarse.
Cuando la legislación federal, de California u otra legislación aplicable exija un resultado diferente, prevalecerá dicha legislación.
47. EXCEPCIONES DISCRECIONALES
Speak It With Ms. Diaz podrá voluntariamente ofrecer un reembolso, crédito, transferencia, reprogramación u otra excepción cuando circunstancias extraordinarias lo justifiquen.
Conceder una excepción en un caso no modifica permanentemente esta Política ni obliga a concederla en otros casos.
48. MODIFICACIONES DE ESTA POLÍTICA
La Política podrá actualizarse para reflejar cambios en programas, métodos de pago, tecnología, operaciones o requisitos legales.
La versión vigente se publicará con su correspondiente fecha.
Para compras existentes se aplicará normalmente la versión vigente al momento de realizarse la compra, salvo cuando un cambio posterior sea legalmente obligatorio o resulte aplicable conforme a la ley.
49. RELACIÓN CON LOS TERMS & CONDITIONS
Esta Refund & Cancellation Policy forma parte de los Terms & Conditions de Speak It With Ms. Diaz.
Cuando una página de inscripción contenga condiciones específicas de cancelación para determinado servicio, deberán interpretarse conjuntamente con esta Política.
Cuando exista un conflicto inevitable, la condición específica comunicada antes de la compra normalmente prevalecerá respecto de ese servicio, sujeto a la legislación aplicable.
