By typing my full legal name and submitting this form, I intend to sign this Consent electronically and acknowledge that my electronic submission may have the same effect as a handwritten signature to the extent permitted by applicable law.

1. Purpose and Scope of This Consent
Speak It With Ms. Diaz provides live online Spanish educational services to minor Students.
This Parent/Guardian Consent & Media Release has two primary purposes:
to obtain Parent/Guardian consent for a Student to appear and/or be heard in educational recordings created during enrolled live online classes; and
to allow the Parent/Guardian to separately decide whether the Student’s image and/or voice may be used for advertising, marketing, or promotional purposes.
Educational Recording Consent and Promotional Media Authorization are separate.
Consent to educational recording does not automatically authorize advertising, marketing, social media, website, or other public promotional use.
Promotional Media Authorization is optional.
This Consent should be read together with the Speak It With Ms. Diaz Privacy Policy and other applicable enrollment policies.
2. Parent/Guardian Authority
By completing and submitting this Consent, the person providing authorization represents that they are:
the Student’s Parent;
the Student’s legal Guardian; or
another adult legally authorized to make the applicable enrollment, privacy, recording, and media-consent decisions for the Student.
The person submitting this Consent represents that they have sufficient legal authority to provide the authorizations selected in this form.
Speak It With Ms. Diaz may request reasonable confirmation of Parent/Guardian identity or authority when appropriate or legally required.
If there is a dispute concerning who has legal authority to provide or withdraw consent for a Student, Speak It With Ms. Diaz may pause enrollment, recording, promotional use, or another affected activity until satisfactory documentation or clarification is provided.
3. Parental Verification
Where applicable law requires additional verification that the person providing consent is the Student’s Parent or legally authorized Guardian, Speak It With Ms. Diaz may use a reasonable verification method permitted by applicable law.
Such verification may include, where appropriate:
direct interaction with the Parent/Guardian during a live video conference;
an appropriately signed or electronically executed consent document;
a qualifying payment transaction;
another legally recognized verification method; or
additional documentation when reasonably necessary.
Speak It With Ms. Diaz may maintain an internal record of the verification method and date.
Submission of this electronic form does not prevent Speak It With Ms. Diaz from requiring an additional verification step where applicable law requires one.
4. Free Trial Classes Are Not Recorded
Free Spanish Trial Classes are not recorded by Speak It With Ms. Diaz.
During a Free Trial, the Student may participate through live video conferencing, which may involve real-time processing of the Student’s:
image or live video;
voice or live audio;
display name;
spoken responses; and
ordinary participation in the session.
Speak It With Ms. Diaz does not intentionally create or retain an educational recording of the Free Trial.
Educational Recording Consent under this document applies to enrolled live classes after the enrollment and consent process has been completed.
Educational Recording Consent
5. Enrolled Classes Are Intended to Be Recorded
The Parent/Guardian understands that enrolled live online classes provided by Speak It With Ms. Diaz are generally intended to be recorded for legitimate educational purposes.
An educational recording may contain the Student’s:
image;
face;
video;
voice;
first name or display name;
spoken responses;
written responses;
educational work;
participation in games or activities;
interactions with Ms. Diaz;
interactions with other Students; and
other content naturally generated through participation in the class.
The Parent/Guardian understands that group recordings may also contain similar information relating to other minor Students participating in the same class.
6. Educational Recording Consent Is Required for Recorded Enrolled Classes
Because enrolled classes are intended to be recorded and, in group classes, may contain the participation of multiple Students, Educational Recording Consent is required for participation in an enrolled class that is recorded under this program.
A Parent/Guardian who is unable or unwilling to provide Educational Recording Consent should contact Speak It With Ms. Diaz before enrollment to discuss whether another service format, if available, may be appropriate.
Promotional Media Authorization is not required for enrollment and remains entirely separate and optional.
7. Purpose of Educational Recordings
Educational recordings may be used for legitimate educational and administrative purposes including:
allowing Students to review class content;
helping enrolled Students review a missed class;
reinforcing previously presented material;
supporting educational continuity;
assisting with instructional planning;
reviewing lesson effectiveness;
addressing legitimate classroom questions;
addressing appropriate administrative questions;
supporting educational follow-up; and
maintaining the quality and continuity of educational services.
Educational recordings are not intended for unrestricted public distribution.
8. Storage and Access to Educational Recordings
Educational recordings may initially be stored through Zoom and/or on a computer controlled by Speak It With Ms. Diaz.
Recordings may then be made available to authorized families through Google Classroom or another approved educational delivery method.
For group classes, the Parent/Guardian understands that the Student may appear or be heard in a recording made available to authorized enrolled families associated with the same class or group.
Likewise, a recording made available to the Parent/Guardian may contain another Student’s:
image;
face;
voice;
first name or display name;
educational work;
responses;
participation; or
classroom interactions.
Access is intended solely for legitimate educational review associated with the applicable class or group.
9. Privacy and Restrictions on Educational Recordings
Educational recordings provided to families are for authorized educational use only.
Without appropriate authorization, the Parent/Guardian and Student may not:
upload an educational recording to social media;
post it publicly;
forward it to unrelated individuals;
sell it;
redistribute it;
livestream it;
screen-record it for redistribution;
extract another Student’s image, video, or audio for public use;
extract another Student’s image, video, or audio for commercial use;
create entertainment, promotional, advertising, or social media content using another Student’s participation;
use another Student’s name, educational work, voice, image, or participation outside the authorized educational purpose; or
otherwise use the recording in a manner that violates another Student’s privacy or applicable law.
The Parent/Guardian is responsible for taking reasonable measures to protect:
Google Classroom access;
recording links;
passwords;
access credentials; and
other restricted classroom information.
10. Recording Availability Is Not Guaranteed
Although enrolled classes are generally intended to be recorded, availability of a recording is not guaranteed.
Technical or operational circumstances may prevent a class from being:
recorded;
saved;
uploaded;
processed;
successfully stored; or
made available.
Examples may include:
internet interruptions;
Zoom or platform failures;
technical errors;
file corruption;
recording errors;
hardware problems;
storage limitations; or
other circumstances outside the reasonable control of Speak It With Ms. Diaz.
Failure of a recording to be available does not necessarily mean that the live class was not properly provided.
11. Educational Recording Retention
Educational recordings are retained for up to 30 days following the applicable class.
A recording may be deleted earlier because of:
storage limitations;
privacy considerations;
security considerations;
technical problems;
administrative needs;
legal requirements; or
other legitimate operational reasons.
Speak It With Ms. Diaz does not guarantee permanent access to any recording.
Educational recordings are not intended to serve as permanent Student archives.
Educational Recording and Promotional Media Are Separate
12. Educational Consent Does Not Equal Promotional Consent
The Parent/Guardian expressly understands that permission for a Student to appear or be heard in an educational recording is separate from permission to use that Student’s image, video, or voice for advertising, marketing, or promotional purposes.
Educational Recording Consent does not automatically authorize Speak It With Ms. Diaz to publish identifiable Student media on:
Facebook;
Instagram;
other social media platforms;
the Speak It With Ms. Diaz website;
paid social media advertisements;
digital advertisements;
promotional videos;
reels;
flyers;
brochures;
email marketing;
presentations;
promotional publications; or
other public advertising or promotional materials.
Promotional use is governed only by the affirmative Promotional Media Authorization selected by the Parent/Guardian.
Optional Promotional Media Authorization
13. Promotional Media Authorization Is Voluntary
Promotional Media Authorization is entirely optional.
A Student will not:
be denied enrollment;
be removed from a program;
be charged a different tuition rate;
receive fewer instructional opportunities;
receive different instructional treatment; or
receive lower-quality instruction
because the Parent/Guardian declines promotional media use or selects a more limited promotional authorization.
Participation in educational services is not conditioned on agreeing to promotional media use.
14. Permitted Promotional Purposes
If affirmatively authorized by the Parent/Guardian, approved Student media may be used by Speak It With Ms. Diaz to advertise, market, promote, or communicate information about its educational services.
Depending on the authorization selected, authorized material may appear in:
the Speak It With Ms. Diaz website;
official social media accounts;
Facebook;
Instagram;
organic social media posts;
paid Meta or social media advertisements;
digital advertisements;
promotional videos;
reels or short-form videos;
flyers;
brochures;
program presentations;
email marketing;
digital promotional materials; and
other legitimate advertising or promotional materials directly related to Speak It With Ms. Diaz and its educational services.
Only the categories of Student media affirmatively authorized by the Parent/Guardian may intentionally be used for these purposes.
15. Option A — Full Media Authorization: Image + Voice
If the Parent/Guardian selects Full Media Authorization — Image + Voice, the Parent/Guardian authorizes Speak It With Ms. Diaz to use approved media containing the Student’s:
image;
face;
video;
voice;
audio;
photographs;
screenshots;
still images; and
authorized video or audio clips
for the advertising, marketing, and promotional purposes described in this Consent.
Authorized media may be reasonably:
edited;
cropped;
resized;
shortened;
formatted;
captioned;
color-corrected;
combined with graphics;
combined with music;
combined with branding;
reframed;
cleaned;
enhanced; or
otherwise prepared for legitimate promotional use.
Speak It With Ms. Diaz will not intentionally edit Student media in a manner designed to materially misrepresent, defame, embarrass, exploit, or portray the Student in an inappropriate context.
This authorization does not constitute authorization to publicly disclose unnecessary sensitive personal information about the Student.
16. Option B — Voice-Only Authorization
If the Parent/Guardian selects Voice-Only Authorization, the Parent/Guardian:
AUTHORIZES promotional use of the Student’s voice or authorized audio; and
DOES NOT AUTHORIZE identifiable promotional use of the Student’s face or visual identity.
Speak It With Ms. Diaz may use an approved portion of the Student’s voice for legitimate advertising, marketing, and promotional purposes described in this Consent.
When Voice-Only Authorization applies, the Student’s identifiable face must not intentionally appear in the final promotional material.
Methods used to protect the Student’s visual identity may include:
removing the visual portion entirely;
cropping the Student out;
reframing the video;
completely covering the face with an emoji, graphic, illustration, shape, or similar element;
applying sufficient blurring or masking;
replacing the relevant visual content; or
another reasonable method designed to make the Student visually non-identifiable.
Merely covering a small portion of the face is not sufficient if visible facial features still make the Student reasonably identifiable.
Speak It With Ms. Diaz will also make reasonable efforts not to combine Voice-Only promotional content with unnecessary identifying information about the Student.
The Parent/Guardian understands that a Student’s voice may be recognizable to someone who already knows the Student. Voice-Only Authorization therefore protects against intentional visual identification but cannot guarantee that the Student’s voice will never be recognized.
17. Option C — No Promotional Media Authorization
If the Parent/Guardian selects No Promotional Media Authorization, the Parent/Guardian does not authorize Speak It With Ms. Diaz to intentionally use the Student’s identifiable:
image;
face;
video; or
voice
for advertising, marketing, social media, website marketing, paid advertising, promotional materials, or other public promotional purposes.
The Student may continue participating fully in the educational program.
No Promotional Media Authorization does not prevent the Student from appearing or being heard in authorized educational recordings covered by Educational Recording Consent.
18. If No Promotional Option Is Selected
If the Parent/Guardian does not affirmatively select a Promotional Media Authorization option, no promotional authorization will be presumed.
The following do not, by themselves, constitute permission for identifiable promotional media use:
silence;
failure to respond;
attendance at class;
enrollment;
payment;
participation in the Free Trial;
acceptance of Terms & Conditions;
Educational Recording Consent; or
continued participation in the educational program.
Unless and until appropriate affirmative Promotional Media Authorization is obtained, Speak It With Ms. Diaz will treat the Student as having No Promotional Media Authorization.
19. Student Names and Other Identifying Information
Promotional Media Authorization for image and/or voice does not automatically authorize public disclosure of the Student’s:
full legal name;
home address;
personal email address;
telephone number;
charter-school account information;
financial information;
private educational information; or
other unnecessary sensitive identifying information.
Speak It With Ms. Diaz will not intentionally publish the Student’s full legal name together with promotional media unless the Parent/Guardian separately and expressly authorizes that disclosure or another lawful basis clearly permits it.
20. Editing, Production, and Third-Party Processing
Authorized promotional media may need to be processed by software or third-party service providers used for:
graphic design;
image editing;
video editing;
audio editing;
captioning;
formatting;
content production;
media hosting;
creative production; or
artificial-intelligence-assisted editing or production.
Such providers may include, where appropriate:
Canva;
CapCut;
OpenAI/ChatGPT; and
comparable authorized production or editing tools.
By selecting Full Media Authorization or Voice-Only Authorization, the Parent/Guardian understands that the authorized media may be processed through such providers to the extent reasonably necessary to create, edit, prepare, format, or distribute the authorized promotional content.
Speak It With Ms. Diaz seeks to limit the Student information provided to these services to what is reasonably necessary for the authorized purpose.
Third-party services maintain their own privacy, security, storage, and processing practices.
21. Additional Protection for Voice-Only Media During Editing
When Voice-Only Authorization has been selected, Speak It With Ms. Diaz will make reasonable efforts to minimize unnecessary disclosure of identifiable visual Student information to third-party promotional editing or production providers.
Where reasonably practical, this may include:
extracting the authorized audio before third-party editing;
removing identifiable video;
de-identifying visual content before upload;
using audio-only files; or
otherwise limiting the submitted material to the type of media authorized by the Parent/Guardian.
Identifiable visual Student media will not intentionally be used for promotional publication under a Voice-Only Authorization.
22. No Authorization for Unrelated Biometric, Voice-Cloning, or AI-Training Purposes
Promotional Media Authorization under this Consent does not constitute authorization for Speak It With Ms. Diaz to intentionally use Student media for:
biometric identification;
facial-recognition profiling;
unrelated behavioral profiling;
creation of a biometric identification database;
voice cloning;
creation of a synthetic version of the Student’s voice;
training a voice-cloning model on the Student;
training a facial-recognition model on the Student;
intentionally training a general-purpose artificial-intelligence model using the Student as training material; or
unrelated commercial exploitation.
Speak It With Ms. Diaz does not intentionally submit Student media to third-party tools for these purposes unless a Parent/Guardian later provides separate express authorization and the activity is otherwise legally permitted.
This provision does not prohibit ordinary technical processing reasonably necessary to provide the authorized educational or promotional service.
23. Retention of Authorized Promotional Media
Authorized promotional source media and completed promotional materials may be retained only as long as reasonably necessary for:
the authorized promotional purpose;
maintaining legitimate business records;
managing existing marketing materials;
documenting applicable authorization;
responding to a dispute; or
satisfying applicable legal obligations.
Promotional media is not intended to be retained indefinitely when there is no continuing legitimate purpose for its retention.
A Parent/Guardian may request withdrawal or modification of future Promotional Media Authorization as described below.
24. Privacy of Other Students
A Parent/Guardian may provide authorization only for their own child.
This Consent does not authorize a Parent/Guardian or Student to:
publish another Student’s image;
publish another Student’s voice;
distribute another Student’s educational work;
use another Student’s classroom participation;
grant rights over another Student’s media; or
otherwise make decisions concerning another Student’s privacy.
When classroom media contains more than one Student, Speak It With Ms. Diaz will consider the authorization status associated with each identifiable Student before using that media for promotional purposes.
If one Student has Full Media Authorization and another Student does not, Speak It With Ms. Diaz may edit, crop, remove, cover, blur, mute, or otherwise modify the material as reasonably necessary to respect the authorization applicable to each Student.
25. Changing or Withdrawing Promotional Authorization
A Parent/Guardian may request to change or withdraw future Promotional Media Authorization by contacting:
The change will apply prospectively after Speak It With Ms. Diaz has received and had a reasonable opportunity to process the request.
After a processed withdrawal, Speak It With Ms. Diaz will not intentionally initiate new promotional uses that conflict with the Parent/Guardian’s current authorization.
Where reasonably practical and within the control of Speak It With Ms. Diaz, existing digital promotional material containing identifiable Student media may also be:
removed;
replaced;
discontinued; or
modified.
However, withdrawal may not make it possible to retrieve or eliminate every copy of material that was lawfully used before the withdrawal and has already been:
printed;
physically distributed;
downloaded by another person;
independently shared or reposted;
copied by unrelated third parties;
cached;
archived by third-party systems; or
otherwise placed outside the reasonable control of Speak It With Ms. Diaz.
Withdrawal of Promotional Media Authorization does not automatically withdraw Educational Recording Consent.
A Parent/Guardian who wishes to discuss Educational Recording Consent should contact Speak It With Ms. Diaz separately.
26. No Compensation for Authorized Promotional Use
Unless a separate written agreement expressly provides otherwise, no royalty, residual, licensing fee, payment, or other compensation is owed solely because authorized Student media is used in accordance with the Promotional Media Authorization selected by the Parent/Guardian.
Declining promotional authorization will not affect:
tuition;
enrollment eligibility;
program fees;
instructional opportunities;
access to educational services; or
instructional treatment.
27. Parent/Guardian Acknowledgment
By submitting this Consent, the Parent/Guardian acknowledges and agrees that:
they are legally authorized to provide the applicable consent for the Student;
Free Spanish Trial Classes are not recorded by Speak It With Ms. Diaz;
enrolled live classes are generally intended to be recorded for educational purposes;
educational recordings may include the Student’s image, face, voice, first name or display name, responses, educational work, and classroom participation;
group recordings may include other minor Students;
group recordings may be available for a limited period to authorized families associated with the applicable class or group;
educational recordings are retained for up to 30 days and may be deleted sooner;
availability of any recording is not guaranteed;
educational recordings may not be redistributed or publicly shared;
Educational Recording Consent is separate from Promotional Media Authorization;
Promotional Media Authorization is optional;
the Parent/Guardian understands the differences between Full Media Authorization, Voice-Only Authorization, and No Promotional Media Authorization;
declining Promotional Media Authorization will not affect the Student’s educational participation or treatment;
authorized promotional media may be reasonably edited and processed as described in this Consent;
promotional authorization may be modified or withdrawn prospectively;
a withdrawal cannot necessarily retrieve every copy already lawfully distributed outside the reasonable control of Speak It With Ms. Diaz; and
the Parent/Guardian has had an opportunity to review this Consent before submitting the form.
28. Required Selections
A. Educational Recording Consent

B. Promotional Media Authorization — Select One

I authorize advertising, marketing, and promotional use of my child’s authorized image, photographs, screenshots, still images, video, and voice as described in this Consent.

I authorize advertising, marketing, and promotional use of my child’s voice as described in this Consent, but I do not authorize identifiable promotional use of my child’s face or visual identity.

I do not authorize advertising, marketing, or promotional use of my child’s identifiable image, video, or voice.

30. Electronic Consent and Signature
When this Consent is completed electronically, the Parent/Guardian’s actions may include:
selecting the applicable authorization options;
checking required acknowledgments;
entering requested information;
typing their full legal name as an electronic signature; and
submitting the form.
By typing their full legal name in the Electronic Signature field and submitting the form, the Parent/Guardian intends to sign this Consent electronically and acknowledges that the electronic submission may have the same effect as a handwritten signature to the extent permitted by applicable law.
Electronic submission may be maintained as evidence of the selections and acknowledgment provided.
Where applicable law requires an additional form of parental verification, Speak It With Ms. Diaz may require an additional verification step before relying on the applicable consent.
31. Relationship to the Privacy Policy and Other Terms
This Parent/Guardian Consent & Media Release should be read together with the applicable:
Privacy Policy
Terms & Conditions
Refund & Cancellation Policy
The Privacy Policy describes broader practices concerning:
information collected from Parents and Students;
Free Trial information;
classroom information;
educational recordings;
service providers;
payments;
website analytics;
cookies;
data retention;
security;
children’s privacy; and
Parent privacy rights.
The Terms & Conditions and Refund & Cancellation Policy govern other aspects of the educational and commercial relationship, including enrollment, participation, payment, cancellations, and refunds.
This Parent/Guardian Consent & Media Release specifically governs:
Educational Recording Consent; and
optional Promotional Media Authorization.
If another policy is updated, the specific authorization affirmatively selected by the Parent/Guardian under this Consent will not be expanded merely by that update where additional consent is legally required.
32. Privacy Rights and Requests
Parents and Guardians may contact Speak It With Ms. Diaz concerning:
Educational Recording Consent;
Promotional Media Authorization;
Voice-Only Authorization;
withdrawal or modification of promotional authorization;
access to information about their child;
correction requests;
deletion requests;
privacy concerns; or
questions about how Student media is handled.
Requests may require reasonable verification of the requester’s identity and authority to act for the Student.
Privacy rights and data-handling practices are described more fully in the Speak It With Ms. Diaz Privacy Policy.
