LANGUAGE AND INTERPRETATION
This Privacy Policy is provided in both English and Spanish to promote accessibility, transparency, and understanding.
Both versions are intended to communicate the same substantive privacy practices.
In the event of an unintended discrepancy, inconsistency, ambiguity, or difference in interpretation between the English and Spanish versions, the English-language version shall govern to the extent permitted by applicable law.
Nothing in this Privacy Policy is intended to waive or restrict any privacy right that cannot lawfully be waived.
1. PURPOSE OF THIS PRIVACY POLICY
Speak It With Ms. Diaz respects the privacy of Students, Parents, Guardians, website visitors, and customers.
This Privacy Policy explains how personal information may be collected, used, disclosed, stored, protected, retained, and deleted in connection with the website, enrollment process, live online classes, educational recordings, communications, payments, and other services provided by Speak It With Ms. Diaz.
Because many services are designed for children, Speak It With Ms. Diaz takes particular care regarding information relating to minor Students.
2. WHO OPERATES SPEAK IT WITH MS. DIAZ
Speak It With Ms. Diaz is operated by Mariana Diaz Sanchez and provides live online Spanish educational services.
For purposes of this Privacy Policy, references to “Speak It With Ms. Diaz,” “we,” “us,” or “our” refer to the business and its authorized operations.
References to “Parent” or “Parent/Guardian” include the adult legally authorized to enroll and make decisions concerning the Student.
References to “Student” generally mean the minor participating in the educational services.
3. SCOPE OF THIS POLICY
This Privacy Policy applies to information processed in connection with:
Speak It With Ms. Diaz's website; enrollment and checkout; inquiries and consultation requests; live online Spanish courses; Personalized Spanish Tutoring; Spanish Conversation Club; educational recordings; customer support; email communications; payment processing; charter school-funded services; and related administrative and educational activities.
Third-party websites, platforms, payment processors, charter schools, or services may maintain their own privacy policies and practices.
4. PARENT/GUARDIAN ROLE IN ENROLLMENT
Services for minor Students are intended to be purchased, authorized, and managed by a Parent or legally authorized Guardian.
Children should not independently purchase services, create paid enrollments, or submit payment information.
By enrolling a minor, the adult represents that they are authorized to make enrollment and consent decisions for that Student.
Where parental consent is legally required for the collection or processing of a child's personal information, Speak It With Ms. Diaz will seek appropriate Parent/Guardian authorization.
5. INFORMATION PROVIDED BY PARENTS OR GUARDIANS
Speak It With Ms. Diaz may collect information voluntarily provided by a Parent/Guardian, including:
Parent/Guardian name;
Email address;
Billing information;
Student name;
Student age;
Student's Spanish experience or approximate speaking level;
Program selected;
Scheduling information;
Charter school information when relevant;
Questions or messages submitted through website forms;
Information shared during a consultation;
Attendance-related communications;
Information necessary to place a Student in an appropriate group;
Consent and authorization selections; and
Other information voluntarily supplied for legitimate educational or administrative purposes.
Speak It With Ms. Diaz seeks to collect only information reasonably necessary for the relevant purpose.
6. INFORMATION ABOUT STUDENTS
Depending on the service, limited Student information may be needed to provide appropriate instruction.
This may include the Student's name, age, approximate Spanish level, educational needs relevant to Spanish instruction, attendance, participation, assignments or educational responses, and information generated during live classes.
Speak It With Ms. Diaz does not request that families provide unnecessary sensitive information about children.
Parents are encouraged not to submit medical, financial, identification, or other highly sensitive information unless specifically necessary and appropriately requested.
7. INFORMATION COLLECTED DURING LIVE ONLINE CLASSES
Participation in live online instruction may generate or involve information such as:
Student display name;
Image or video;
Voice or audio;
Spoken responses;
Written responses;
Classroom interactions;
Educational work;
Participation in games and activities;
Attendance;
Chat messages where applicable;
Student-created educational content; and
Other information naturally generated through participation in a live class.
This information is used primarily for educational delivery, participation, communication, instructional continuity, and legitimate administration of the program.
8. EDUCATIONAL RECORDINGS
Live classes are intended to be recorded for legitimate educational purposes, subject to applicable Parent/Guardian consent and legal requirements.
Recordings may contain a Student's image, voice, first name or display name, spoken responses, educational work, and interactions with the Instructor or other Students.
Educational recording is separate from promotional media authorization.
Consent to an educational recording does not automatically constitute consent to use identifiable Student content for advertising, marketing, social media, or other promotional purposes.
9. PURPOSE OF EDUCATIONAL RECORDINGS
Educational recordings may be used to:
Allow Students to review material;
Help Students who missed a live class;
Reinforce learning;
Maintain educational continuity;
Support instructional planning;
Review lesson effectiveness;
Address legitimate classroom or administrative questions; and
Support quality and continuity of educational services.
Recordings are not created for unrestricted public distribution.
10. ACCESS TO EDUCATIONAL RECORDINGS
Where recordings are made available to families, access is intended to be limited to authorized individuals associated with the applicable educational service or class.
Parents and Students may not download, reproduce, screen-record, republish, publicly display, sell, distribute, post, or share recordings unless Speak It With Ms. Diaz has expressly authorized the specific use.
This restriction is particularly important because a group recording may contain the image, voice, work, or participation of other minor Students.
11. RECORDING RETENTION
Educational class recordings are intended to remain available for approximately 30 days after the applicable class.
After the applicable period, recordings may be deleted, removed from Student access, or otherwise no longer maintained when they are no longer reasonably necessary.
A recording may be deleted earlier for privacy, security, technical, legal, or administrative reasons.
Speak It With Ms. Diaz does not guarantee permanent archival availability of class recordings.
Technical failures may occasionally prevent a class from being successfully recorded or preserved.
12. RECORDINGS ARE NOT GUARANTEED
Although classes are intended to be recorded, Speak It With Ms. Diaz cannot guarantee that every recording will be successfully created, saved, uploaded, processed, or remain accessible for the full anticipated period.
Platform failures, internet interruptions, file corruption, storage errors, or other technical issues may prevent availability.
The recording is a supplemental educational resource and is not a guaranteed permanent product.
13. EDUCATIONAL USE AND PROMOTIONAL USE ARE DIFFERENT
Speak It With Ms. Diaz distinguishes between:
Educational Recording and Use — necessary or appropriate for instruction, review, continuity, and program administration; and
Promotional Media Use — use of Student image, video, or voice in advertising, social media, website content, promotional materials, or marketing.
Promotional authorization is optional.
Declining promotional authorization does not prevent a Student from receiving the educational service.
14. PROMOTIONAL MEDIA CHOICES
Parents/Guardians will be given meaningful choices regarding promotional media.
The available authorization options are:
OPTION A — FULL MEDIA AUTHORIZATION: IMAGE AND VOICE
The Parent/Guardian authorizes Speak It With Ms. Diaz to use approved portions of the Student's image, video, and voice for legitimate promotional purposes, subject to the Parent/Guardian Consent & Media Release.
OPTION B — VOICE-ONLY AUTHORIZATION
The Parent/Guardian does not authorize identifiable visual use of the Student but permits use of the Student's voice for approved promotional purposes.
When Voice-Only Authorization applies, the Student's face must be completely obscured, covered, cropped out, blurred, replaced with an appropriate visual covering such as an emoji, or otherwise rendered visually non-identifiable.
Speak It With Ms. Diaz will take reasonable measures to avoid including visible identifying information associated with the Student.
OPTION C — NO PROMOTIONAL AUTHORIZATION
The Parent/Guardian does not authorize promotional use of the Student's identifiable image or identifiable voice.
The Student may still participate fully in the educational program.
15. VOICE-ONLY AUTHORIZATION AND ANONYMITY
When a Parent selects Voice-Only Authorization, Speak It With Ms. Diaz may use an authorized portion of the Student's audio while ensuring that the Student's face is not visible or reasonably identifiable.
Visual de-identification may include cropping, blurring, masking, covering the entire face with an emoji or graphic, or another reasonable method.
Where reasonably necessary to maintain anonymity, other directly identifying visual information should also be removed or obscured.
The purpose of this option is to permit limited use of the Student's voice while protecting the Student's visual identity.
16. LIMITATIONS OF DE-IDENTIFICATION
Covering a Student's face does not necessarily make all surrounding information anonymous.
Accordingly, Speak It With Ms. Diaz will make reasonable efforts not to combine Voice-Only content with the Student's full name or other information that would unnecessarily identify the Student.
A Student's full name should not be intentionally displayed in promotional material merely because Voice-Only Authorization has been granted.
17. NO PROMOTIONAL USE BASED ON SILENCE
A Parent's failure to respond, failure to select an authorization option, attendance at a class, or acceptance of the general Terms & Conditions will not by itself be treated as affirmative permission for identifiable promotional use.
Promotional authorization should be obtained through the applicable Parent/Guardian Consent & Media Release or another appropriate affirmative authorization mechanism.
18. WITHDRAWAL OR CHANGE OF PROMOTIONAL CONSENT
A Parent/Guardian may contact Speak It With Ms. Diaz to withdraw or modify future promotional authorization.
A change will apply to future uses after Speak It With Ms. Diaz has had a reasonable opportunity to process the request.
Where reasonably practicable and within the control of Speak It With Ms. Diaz, existing digital promotional content containing identifiable Student material may also be removed or modified following withdrawal.
However, withdrawal may not always allow Speak It With Ms. Diaz to retrieve materials already lawfully distributed, printed, reposted by unrelated third parties, archived by third-party systems, or otherwise outside its reasonable control.
19. PROMOTIONAL CONSENT DOES NOT AFFECT EDUCATIONAL TREATMENT
A Student will not receive lower-quality instruction, fewer opportunities to participate, different academic treatment, or different pricing solely because a Parent:
Declines promotional authorization;
Selects Voice-Only Authorization;
Declines both image and voice use; or
Later withdraws optional promotional authorization.
Promotional consent is voluntary and separate from the educational relationship.
20. WEBSITE INFORMATION
When a person visits the Speak It With Ms. Diaz website, certain technical information may be automatically processed by the website, hosting provider, analytics technologies, security technologies, or related service providers.
Depending on the technologies enabled on the website, this may include:
IP address;
Browser type;
Device type;
Operating system;
Approximate geographic information derived from an IP address;
Referring page;
Pages visited;
Date and time of access;
Cookie or similar identifiers; and
Technical information used for security, functionality, or analytics.
The precise information collected may depend on the website technologies currently enabled.

Parents should provide only the information requested and reasonably necessary for enrollment.
23. PAYMENT INFORMATION
Payments may be processed by an authorized third-party payment processor.
Speak It With Ms. Diaz does not ordinarily need to receive or store a customer's complete payment-card number when payment information is securely submitted directly to the payment processor.
The payment provider may process information such as card or account information, billing details, transaction amount, fraud-prevention information, and transaction identifiers in accordance with its own privacy and security practices.
Speak It With Ms. Diaz may retain transaction records such as amount paid, date, purchased service, payment status, refund status, and transaction reference where necessary for accounting, customer support, dispute resolution, or legal compliance.
24. PAYMENT SECURITY
Speak It With Ms. Diaz uses third-party payment infrastructure rather than intentionally storing complete payment-card credentials in ordinary business records.
No online payment system can be guaranteed to be completely risk-free.
Parents should use secure devices and networks when submitting payment information and should promptly report suspected unauthorized transactions to the appropriate financial institution.
25. HOW PERSONAL INFORMATION IS USED
Personal information may be used for legitimate purposes including:
Processing enrollment;
Delivering classes;
Communicating with Parents;
Scheduling services;
Forming appropriate groups;
Providing tutoring;
Maintaining attendance;
Providing educational recordings;

Student information will not intentionally be used for unrelated purposes merely because Speak It With Ms. Diaz possesses it.
26. DATA MINIMIZATION
Speak It With Ms. Diaz seeks to limit the collection of Student information to what is reasonably appropriate for providing educational services, communicating with Parents, maintaining legitimate records, protecting participants, and complying with legal obligations.
Families are discouraged from submitting unnecessary personal information about children.
27. INFORMATION SPEAK IT WITH MS. DIAZ DOES NOT INTENTIONALLY REQUEST FROM CHILDREN
Unless genuinely necessary for a specific educational or legal purpose, Speak It With Ms. Diaz does not intentionally request from minor Students information such as:
Social Security numbers;
Government identification numbers;
Complete financial-account information;
Payment-card numbers;
Passwords to unrelated services; or
Other highly sensitive information unrelated to Spanish instruction.
Payment information should be provided by the Parent/Guardian through the authorized payment process.
28. THIRD-PARTY SERVICE PROVIDERS
Providing online education requires the use of third-party services.
Information may therefore be processed by service providers supporting functions such as:
Website hosting;
Payment processing;
Email;
Video conferencing;
Educational technology;
Scheduling;
Cloud storage;
Recording storage or delivery;
Website security;
Analytics;
Customer communications; and
Administrative operations.
Information should be disclosed to such providers only to the extent reasonably necessary for the relevant service or otherwise permitted by law.
29. THIRD-PARTY PRIVACY PRACTICES

Speak It With Ms. Diaz seeks to use appropriate services but does not control every independent technical or privacy practice of third-party providers.
Parents may review the privacy policies of relevant third-party services when they wish to understand those providers' practices in greater detail.
30. SPEAK IT WITH MS. DIAZ DOES NOT SELL STUDENT PERSONAL INFORMATION
Speak It With Ms. Diaz does not sell Student personal information for monetary consideration.
Student information is collected and used primarily to provide and administer educational services.
If business technologies involving advertising, analytics, or cross-context behavioral advertising are used in a manner legally considered a “sale” or “sharing” under applicable privacy law, any legally required notices and rights will be provided.
31. DISCLOSURE OF INFORMATION
Personal information may be disclosed when reasonably necessary:
To provide the purchased educational service;
To authorized service providers;
To process payments or refunds;
To a charter school when required for an authorized charter-funded service;
With Parent/Guardian authorization;
To comply with applicable law, court order, subpoena, or lawful government request;
To protect the rights or safety of a Student, Parent, Instructor, or another person;
To investigate fraud or security incidents;
To enforce applicable agreements; or
In connection with legitimate business administration permitted by law.
Speak It With Ms. Diaz does not disclose children's personal information casually or for unrelated purposes.
32. CHARTER SCHOOL INFORMATION
When services are funded through a charter school, Speak It With Ms. Diaz may receive or provide information reasonably necessary to administer the authorized service.
This may include Student name, Parent information, service information, attendance, dates of instruction, invoices, purchase-order information, or other records required by the school.
The charter school may separately maintain information under its own policies and legal obligations.
Speak It With Ms. Diaz will not intentionally provide unrelated Student information to a charter school merely because the school funded a service.
33. EMAIL AND COMMUNICATIONS
Speak It With Ms. Diaz may use Parent contact information to send communications relating to:
Enrollment;
Class schedules;
Schedule changes;
Student attendance;
Educational resources;
Recordings;
Payments;
Renewals;
Program administration;
Customer service;
Policy updates; and
Other matters reasonably related to the educational relationship.
These service-related communications may be necessary to provide the purchased program and are different from optional marketing communications.
34. MARKETING COMMUNICATIONS
Where marketing emails or similar optional communications are offered, Speak It With Ms. Diaz may request separate marketing consent when required.
A Parent's decision not to receive optional marketing communications will not affect the child's participation in purchased educational services.
Users may unsubscribe from optional marketing communications through the available method.
Service-related messages may still be sent when reasonably necessary to administer an active enrollment or transaction.
35. DATA SECURITY
Speak It With Ms. Diaz uses reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or inappropriate disclosure.
Such measures may include use of reputable service providers, access controls, password protection, limited access to Student information, secure payment infrastructure, and appropriate account practices.
However, no internet transmission, online platform, or electronic storage system can be guaranteed to be completely secure.
36. PARENT RESPONSIBILITY FOR ACCOUNT AND LINK SECURITY
Parents are responsible for protecting class links, passwords, account credentials, recording links, and other access information provided to their family.
Families should not publicly post or distribute private class links or recording-access information.
If a Parent believes access information has been compromised, Speak It With Ms. Diaz should be contacted promptly so reasonable protective measures can be considered.
37. STUDENT PRIVACY IN THE HOME ENVIRONMENT
Because classes take place remotely, Parents should consider what may be visible or audible in the Student's environment.
Families are encouraged to choose an appropriate learning location and avoid displaying sensitive documents, addresses, financial information, private conversations, or other unnecessary personal information on camera.
Speak It With Ms. Diaz cannot control everything that a Student voluntarily displays or says from the family's physical environment.
38. OTHER STUDENTS' PRIVACY
Students and Parents must respect the privacy of other class participants.
Information learned solely because another child participates in a class should not be exploited, publicly disclosed, or distributed.
Class recordings, screenshots, photographs, names, voices, or other Student content may not be shared publicly by participating families without appropriate authorization.
39. RETENTION OF PARENT AND BUSINESS RECORDS
Certain information may need to be retained beyond the duration of a course for legitimate business purposes.
This may include transaction records, invoices, tax/accounting records, enrollment records, consent records, refund records, relevant communications, and information reasonably necessary to establish or defend legal rights.
Retention periods may depend on the type of record and applicable legal, accounting, contractual, or operational requirements.
Information should not be retained indefinitely merely because it can be retained.
40. RETENTION OF STUDENT INFORMATION
Student information will be retained only for as long as reasonably necessary for the educational, administrative, legal, security, or recordkeeping purpose for which it was collected.
Information that is no longer reasonably needed should be deleted, de-identified, or otherwise appropriately handled, subject to legitimate retention obligations.
41. PARENT REQUESTS REGARDING STUDENT INFORMATION
A Parent/Guardian may contact Speak It With Ms. Diaz regarding personal information associated with their child.
Depending on the circumstances and applicable law, a Parent may request:
Information about data collected;
Access to certain information;
Correction of inaccurate information;
Deletion of certain information;
Withdrawal or modification of optional promotional consent; or
Information concerning relevant data practices.
Identity and parental authority may need to be reasonably verified before a request is fulfilled.
42. DELETION REQUESTS
When a valid deletion request is received, Speak It With Ms. Diaz will evaluate the information requested for deletion.
Some information may need to be retained when reasonably necessary or legally permitted, including for:
Completing an existing transaction;

44. CHILDREN'S PRIVACY
Speak It With Ms. Diaz recognizes that information concerning children requires additional care.
Services for minor Students are intended to be managed by Parents/Guardians.
Speak It With Ms. Diaz seeks to obtain appropriate parental authorization when required before collecting or using children's personal information and seeks to limit collection to information reasonably necessary for educational and administrative purposes.
45. CHILDREN UNDER 13
Because programs may include children under 13, Speak It With Ms. Diaz will seek to structure enrollment and data collection so that the Parent/Guardian initiates and authorizes the child's participation.
Where applicable law requires verifiable parental consent before collecting personal information directly from a child under 13, Speak It With Ms. Diaz will seek the required authorization before engaging in the applicable collection or use.
Parents should contact Speak It With Ms. Diaz if they believe personal information from a child has been collected without appropriate authorization.
46. INFORMATION SUBMITTED BY A CHILD WITHOUT AUTHORIZATION
If Speak It With Ms. Diaz learns that a child submitted personal information in circumstances requiring parental authorization and such authorization was not obtained, reasonable steps may be taken to obtain appropriate consent or delete the information, as applicable.
47. CALIFORNIA PRIVACY RIGHTS
California residents may have privacy rights under applicable California law.
Depending on the law that applies to Speak It With Ms. Diaz and the circumstances, these may include rights concerning access, correction, deletion, information about collection and disclosure, or other privacy choices.
Not every California privacy statute or right applies to every business or transaction.
Speak It With Ms. Diaz will honor privacy rights that apply to its operations.
48. NO DISCRIMINATION FOR EXERCISING APPLICABLE PRIVACY RIGHTS
Speak It With Ms. Diaz will not unlawfully discriminate against a Parent or Student solely because they exercise a privacy right provided by applicable law.
Similarly, declining optional promotional authorization will not reduce the quality of the Student's educational services.
49. DATA BREACHES OR SECURITY INCIDENTS
If Speak It With Ms. Diaz becomes aware of a security incident affecting personal information, reasonable steps will be taken to investigate, contain, and address the incident.
Where applicable law requires notification to affected individuals or authorities, such notification will be provided in accordance with applicable requirements.
50. LEGAL AND SAFETY DISCLOSURES
Speak It With Ms. Diaz may preserve or disclose information when reasonably believed necessary to comply with law, respond to lawful legal process, investigate fraud or security concerns, enforce agreements, or protect the rights, safety, or well-being of Students, families, the Instructor, or others.
This provision does not authorize unnecessary disclosure.
51. BUSINESS TRANSFERS
If Speak It With Ms. Diaz is reorganized, sold, transferred, or otherwise undergoes a legitimate business transition, relevant business records may be transferred as permitted by law.
Any successor receiving personal information would be expected to handle it consistently with applicable privacy obligations.
Special care should continue to be applied to information relating to minor Students.
52. THIRD-PARTY LINKS
The website may contain links to third-party websites or services.
Speak It With Ms. Diaz is not responsible for the independent privacy practices of websites it does not operate.
Parents should review relevant third-party policies before voluntarily providing information to those services.
53. INTERNATIONAL ACCESS
Although Speak It With Ms. Diaz operates in California, individuals may potentially access online services from other locations.
Different jurisdictions may impose different privacy requirements.
Where another law is legally applicable to a particular transaction or individual, Speak It With Ms. Diaz will seek to comply with applicable requirements.

Speak It With Ms. Diaz respeta la privacidad de Estudiantes, Padres/Tutores, visitantes y clientes.
Esta Política explica cómo puede recopilarse, utilizarse, divulgarse, almacenarse, protegerse, conservarse y eliminarse información personal relacionada con el sitio web, inscripciones, clases, grabaciones, comunicaciones, pagos y demás servicios.
Debido a que muchos servicios están dirigidos a menores, se presta especial atención a la información de los Estudiantes.
2. RESPONSABLE DE SPEAK IT WITH MS. DIAZ
Speak It With Ms. Diaz es operado por Mariana Diaz Sanchez y proporciona servicios educativos de español en línea.
“Padre/Tutor” significa el adulto legalmente autorizado para inscribir y tomar decisiones relacionadas con el Estudiante.
“Estudiante” generalmente significa el menor que participa en los servicios.
3. ALCANCE
Esta Política aplica al sitio web, checkout, inscripciones, consultas, cursos en vivo, Personalized Spanish Tutoring, Spanish Conversation Club, grabaciones educativas, soporte, comunicaciones, pagos, servicios financiados por charter schools y actividades administrativas relacionadas.
Servicios externos pueden mantener sus propias políticas.
4. FUNCIÓN DEL PADRE/TUTOR
Los servicios para menores deben ser contratados y administrados por un Padre/Tutor legalmente autorizado.
Los niños no deberán realizar compras o proporcionar información de pago independientemente.
Cuando legalmente se requiera consentimiento parental para recopilar o tratar información de un menor, Speak It With Ms. Diaz buscará obtener la autorización correspondiente.
5. INFORMACIÓN PROPORCIONADA POR PADRES/TUTORES
Podrá recopilarse información como nombre del Padre/Tutor, email, información de facturación, nombre y edad del Estudiante, experiencia previa con español, programa seleccionado, horario, información de charter school cuando corresponda, consultas, asistencia, placement, autorizaciones y otra información necesaria.
Se procurará solicitar únicamente información razonablemente necesaria.
6. INFORMACIÓN DEL ESTUDIANTE
Podrá procesarse información limitada del Estudiante necesaria para proporcionar instrucción apropiada, incluyendo nombre, edad, nivel aproximado de español, necesidades educativas relevantes para la enseñanza del idioma, asistencia, participación, respuestas educativas e información generada durante clases.
No se solicita intencionalmente información sensible innecesaria.
7. INFORMACIÓN GENERADA DURANTE CLASES
Las clases pueden involucrar nombre mostrado, imagen, video, voz, respuestas, trabajos, interacciones, juegos, asistencia, mensajes de chat y otro contenido educativo.
Se utiliza principalmente para enseñanza, participación, comunicación, continuidad educativa y administración legítima.
8. GRABACIONES EDUCATIVAS
Las clases en vivo están destinadas a ser grabadas para fines educativos legítimos, sujetas al consentimiento parental y requisitos legales aplicables.
Las grabaciones pueden contener imagen, voz, nombre mostrado, respuestas y participación.
Consentir una grabación educativa no significa automáticamente consentir publicidad.
9. FINALIDAD DE LAS GRABACIONES
Podrán utilizarse para revisión, recuperación de clases perdidas, refuerzo, continuidad educativa, planeación, evaluación de la efectividad de una lección, resolución de asuntos legítimos de clase y calidad educativa.
No se crean para distribución pública irrestricta.
10. ACCESO
Cuando se compartan grabaciones, el acceso estará destinado únicamente a personas autorizadas relacionadas con el servicio o grupo correspondiente.
Queda prohibido descargar, grabar pantalla, reproducir, vender, publicar o distribuir las grabaciones sin autorización.
11. RETENCIÓN DE GRABACIONES
Las grabaciones estarán destinadas a permanecer disponibles aproximadamente 30 días.
Posteriormente podrán eliminarse o dejar de estar disponibles.
También podrán eliminarse antes por razones de privacidad, seguridad, técnicas, legales o administrativas.
12. LAS GRABACIONES NO ESTÁN GARANTIZADAS
Aunque se pretende grabar las clases, no puede garantizarse que todas las grabaciones se creen, guarden o permanezcan disponibles debido a posibles fallas técnicas.
Constituyen un recurso educativo complementario y no un archivo permanente garantizado.
13. USO EDUCATIVO VS. PROMOCIONAL
El uso educativo comprende enseñanza, revisión y continuidad.
El uso promocional comprende publicidad, redes sociales, website y marketing.
La autorización promocional es opcional y separada.
14. OPCIONES DE AUTORIZACIÓN PROMOCIONAL
OPCIÓN A — IMAGEN Y VOZ
Autoriza el uso aprobado de imagen, video y voz para fines promocionales legítimos.
OPCIÓN B — ÚNICAMENTE VOZ
No autoriza el uso visual identificable, pero permite utilizar la voz.
El rostro deberá permanecer completamente cubierto, recortado, desenfocado, oculto mediante emoji u otro elemento gráfico, o visualmente desidentificado.
OPCIÓN C — SIN AUTORIZACIÓN PROMOCIONAL
No autoriza uso promocional de imagen identificable ni voz identificable.
El Estudiante podrá participar plenamente en el programa.
15. AUTORIZACIÓN DE VOZ Y ANONIMATO
Cuando se seleccione únicamente voz, podrá utilizarse audio autorizado mientras el rostro permanezca no identificable.
También se procurará eliminar información visual que identifique directamente al menor cuando resulte razonablemente necesario.
16. LÍMITES DE LA DESIDENTIFICACIÓN
Cubrir el rostro no siempre elimina todos los elementos identificadores.
Por ello, la autorización únicamente de voz no autoriza automáticamente publicar el nombre completo del Estudiante u otros datos que innecesariamente revelen su identidad.
17. EL SILENCIO NO CONSTITUYE CONSENTIMIENTO
No responder, asistir a clases o aceptar los Terms & Conditions no será considerado por sí mismo autorización afirmativa para uso promocional identificable.
18. RETIRO DEL CONSENTIMIENTO PROMOCIONAL
El Padre/Tutor podrá modificar o retirar autorización para usos futuros.
Cuando sea razonablemente posible y se encuentre bajo control de Speak It With Ms. Diaz, contenido digital existente también podrá retirarse o modificarse.
No siempre será posible recuperar contenido legítimamente distribuido o fuera del control razonable del negocio.
19. LA DECISIÓN NO AFECTA LA EDUCACIÓN
Negarse a publicidad, elegir únicamente voz o retirar autorización no reducirá la calidad educativa, participación, precio o tratamiento del Estudiante.
20. INFORMACIÓN DEL WEBSITE
El website y sus proveedores pueden procesar datos técnicos como dirección IP, navegador, dispositivo, sistema operativo, ubicación aproximada derivada de IP, páginas visitadas, horarios, cookies y datos de seguridad o analítica.
21. COOKIES
Podrán utilizarse cookies para funcionamiento, preferencias, checkout, seguridad, prevención de fraude, rendimiento, analítica y, cuando corresponda legalmente, marketing.
Cuando se requiera consentimiento legal, deberán utilizarse mecanismos apropiados.
22. CHECKOUT E INSCRIPCIÓN
Durante checkout podrán solicitarse datos necesarios para identificar comprador y Estudiante, procesar inscripción y proporcionar el servicio.
Por ejemplo:
Student's Full Name & Age.
Las familias deberán proporcionar únicamente información necesaria.
23. INFORMACIÓN DE PAGO
Los pagos podrán procesarse mediante proveedores externos autorizados.
Speak It With Ms. Diaz normalmente no necesita recibir ni almacenar el número completo de la tarjeta.
Podrán conservarse registros como monto, fecha, servicio, estado de pago, reembolso e identificadores de transacción.
24. SEGURIDAD DE PAGOS
Se utiliza infraestructura externa de procesamiento de pagos en lugar de almacenar intencionalmente credenciales completas de tarjetas.
Ningún sistema online puede garantizar riesgo cero.
25. USO DE INFORMACIÓN
La información podrá utilizarse para inscripción, enseñanza, comunicaciones, horarios, formación de grupos, tutoring, asistencia, grabaciones, pagos, reembolsos, soporte, registros, seguridad, prevención de fraude, cumplimiento contractual y legal y mejora de servicios.
26. MINIMIZACIÓN DE DATOS
Se procura recopilar únicamente la información razonablemente apropiada para fines educativos, administrativos, legales y de seguridad.
27. INFORMACIÓN QUE NO SE SOLICITA INTENCIONALMENTE A MENORES
Normalmente no se solicitarán números de Seguro Social, identificaciones gubernamentales, información financiera completa, números de tarjetas, contraseñas ajenas u otros datos altamente sensibles no relacionados con la enseñanza.
28. PROVEEDORES EXTERNOS
Podrán utilizarse proveedores para hosting, pagos, email, videoconferencias, tecnología educativa, scheduling, almacenamiento, grabaciones, seguridad, analítica, comunicaciones y administración.
La información deberá compartirse únicamente en la medida razonablemente necesaria o legalmente permitida.
29. POLÍTICAS DE TERCEROS
Los proveedores externos mantienen sus propias prácticas.
Los Padres pueden consultar sus políticas correspondientes.
30. NO VENTA DE INFORMACIÓN DE ESTUDIANTES
Speak It With Ms. Diaz no vende información personal de Estudiantes a cambio de dinero.
Si alguna tecnología publicitaria o analítica llegara legalmente a constituir “sale” o “sharing” conforme a una ley aplicable, se proporcionarán los avisos y derechos correspondientes.
31. DIVULGACIÓN
La información podrá compartirse cuando sea razonablemente necesario para prestar el servicio, procesar pagos, trabajar con proveedores autorizados, administrar servicios de charter schools, cumplir la ley, proteger seguridad, investigar fraude o ejercer derechos legales.
No se comparte información de menores de manera casual o para fines no relacionados.
32. CHARTER SCHOOLS
Cuando una charter school financie el servicio, podrán intercambiarse datos razonablemente necesarios como nombre, información parental, servicio, asistencia, fechas, facturas y purchase orders.
No se proporcionará intencionalmente información ajena al servicio únicamente porque una charter school lo financie.
33. EMAILS Y COMUNICACIONES
Podrán enviarse mensajes sobre inscripción, horarios, cambios, asistencia, recursos, grabaciones, pagos, renovaciones, administración, soporte y actualizaciones necesarias.
34. MARKETING
Las comunicaciones opcionales de marketing podrán requerir consentimiento separado.
Rechazar marketing no afecta los servicios adquiridos.
35. SEGURIDAD
Se aplican medidas administrativas, técnicas y organizacionales razonables destinadas a proteger información contra acceso no autorizado, pérdida, uso indebido o divulgación inapropiada.
Ningún sistema puede garantizar seguridad absoluta.
36. SEGURIDAD DE LINKS Y CUENTAS
Los Padres son responsables de proteger links de clases, passwords, credenciales y links de grabaciones.
No deberán publicarlos ni distribuirlos.
37. PRIVACIDAD DEL ENTORNO DEL HOGAR
Las familias deberán considerar qué aparece o se escucha detrás del Estudiante durante clases.
Se recomienda evitar mostrar documentos, direcciones, información financiera o conversaciones privadas.
38. PRIVACIDAD DE OTROS ESTUDIANTES
Padres y Estudiantes deberán respetar la privacidad de otros participantes.
No podrán divulgar públicamente grabaciones, screenshots, fotografías, nombres, voces o contenido de otros menores sin autorización apropiada.
39. RETENCIÓN DE REGISTROS DEL NEGOCIO
Podrán conservarse facturas, transacciones, registros fiscales, inscripciones, consentimientos, reembolsos y comunicaciones durante el tiempo razonablemente necesario para fines legales, fiscales, administrativos o de defensa de derechos.
40. RETENCIÓN DE DATOS DEL ESTUDIANTE
La información del Estudiante se conservará únicamente mientras resulte razonablemente necesaria para fines educativos, administrativos, legales, de seguridad o registros.
Posteriormente deberá eliminarse, desidentificarse o tratarse apropiadamente.
41. SOLICITUDES DE LOS PADRES
Dependiendo de la legislación aplicable, los Padres podrán solicitar acceso, corrección, eliminación, información sobre prácticas de datos o modificación de consentimiento promocional.
Podrá requerirse verificación razonable de identidad y autoridad parental.
42. SOLICITUDES DE ELIMINACIÓN
Una solicitud válida será evaluada y la información se eliminará cuando corresponda.
Algunos datos podrán conservarse para completar transacciones, impuestos, disputas, prevención de fraude, evidencia de consentimiento, seguridad, derechos legales o cumplimiento normativo.
43. CORRECCIÓN
Los Padres podrán solicitar correcciones de información inexacta.
Podrá solicitarse verificación razonable antes de realizar cambios materiales.
44. PRIVACIDAD INFANTIL
Speak It With Ms. Diaz reconoce que la información de menores requiere especial protección.
Los servicios deben ser gestionados por Padres/Tutores y la recopilación debe limitarse a fines educativos y administrativos legítimos.
45. MENORES DE 13 AÑOS
Debido a que pueden participar menores de 13 años, se procurará estructurar la inscripción para que el Padre/Tutor inicie y autorice la participación.
Cuando la legislación aplicable requiera consentimiento parental verificable para determinada recopilación directa de información de un menor, se buscará obtener dicha autorización.
46. INFORMACIÓN ENVIADA SIN AUTORIZACIÓN
Cuando se determine que un menor proporcionó información en circunstancias que requerían consentimiento parental y éste no fue obtenido, podrán adoptarse medidas razonables para obtener autorización o eliminar la información.
47. DERECHOS DE PRIVACIDAD DE CALIFORNIA
Los residentes de California pueden tener derechos conforme a las leyes aplicables, incluyendo en determinadas circunstancias acceso, corrección, eliminación e información sobre recopilación y divulgación.
No todas las leyes o derechos aplican necesariamente a todos los negocios.
Speak It With Ms. Diaz respetará aquellos que legalmente sean aplicables.
48. NO DISCRIMINACIÓN
No se discriminará ilegalmente a una familia por ejercer derechos de privacidad aplicables.
Rechazar publicidad tampoco afectará la calidad de la educación.
49. INCIDENTES DE SEGURIDAD
Ante un incidente de seguridad, se tomarán medidas razonables para investigar, contener y atender la situación.

51. TRANSFERENCIA DEL NEGOCIO
En una reorganización, venta o transferencia legítima del negocio, registros relevantes podrán transferirse conforme a la ley.
La información de menores deberá continuar recibiendo protección apropiada.
52. LINKS EXTERNOS
Speak It With Ms. Diaz no controla las prácticas independientes de websites externos enlazados desde su sitio.
53. ACCESO INTERNACIONAL
Aunque Speak It With Ms. Diaz opera en California, los servicios online pueden ser accesibles desde otros lugares.
Cuando otra legislación resulte legalmente aplicable, se procurará cumplir sus requisitos.
54. CAMBIOS A ESTA POLÍTICA
